IPhone owners seek class action over throttling of performance

It was a CPU speed limit created to stop older model iPhones from demanding too much from batteries with diminished capacity, thus preventing the handsets from rapidly running out of power and shutting down.

"Our goal is to deliver the best experience for customers, which includes overall performance and prolonging the life of their devices".

The company insists its software updates were actually created to prevent surprise shut downs and prolong battery life.

"Apple's failure to inform consumers these updates would wreak havoc on the phone's performance is being deemed purposeful, and if proven, constitutes the unlawful and decisive withholding of material information", he said in a statement. Apple charges $79 to replace batteries not covered under the phone's warranty. The same phone when outfitted with a brand new battery had its processor performing at peak capacity. The iPhone 7 was first launched in September 2016, and was subject to Apple's throttling mechanism in iOS 11.2.

Apple faces two class action lawsuits claiming that it deceived customers using an "immoral" tactic to slow down older phones. Both plaintiffs are owners of iPhone 7 handsets as well as several previous generations.

Is your older iPhone running slow? The company has not just earned criticism but also a lawsuit now.

They filed the lawsuit after Apple acknowledged Wednesday for the first time that it installed a feature previous year for iPhone 6, 6S and SE models that have a degraded and aged battery, to prevent unexpected shutdowns.

The allegations were in a lawsuit filed Thursday in Chicago federal court on behalf of five iPhone owners from Illinois, Ohio, Indiana and North Carolina, all of whom say they never would have bought new iPhones had Apple told them that simply replacing the batteries would have sped up their old ones. Even John Gruber, who blogs about Apple under the pseudonym Daring Fireball, said that the company should have communicated with customers in a more forthcoming manner. The suit alleges Apple violated consumer fraud laws.

"Defendant never requested consent or did Plaintiffs at any time give consent for Defendant to slow down their iPhones", states one of the "substantive allegations" in the suit, which was filed Thursday in California and posted by a TV station in NY. But when it comes to the decision Apple made to handle the issue I believe they made the right call.
