On Wednesday, Trump called the United States justice system a slow-moving "joke" and "laughingstock" and said he would be open to seeing Saipov transferred to the USA prison at Guantanamo Bay, Cuba, where enemy combatants are tried by military tribunals.

"Would love to send the NYC terrorist to Guantanamo but statistically that process takes much longer than going through the Federal system", Trump wrote.

At the top of a cabinet meeting on Wednesday, Trump said that he would be open to Saipov, a 29 year-old immigrant from Uzbekistan, being detained in Guantanamo Bay, a facility in Cuba that holds terror suspects.

Brought to court in a wheelchair, Saipov was held without bail on charges that could bring the death penalty.

Trump's Guantanamo tweets reflect a reality at the naval base: If Saipov were sent there his trial would likely be delayed by many years. Federal prosecutors have announced two charges so far: provision of material support and resources to a designated foreign terrorist organisation, and violence and destruction of motor vehicles. As a permanent legal resident of the United States Saipov also has virtually the same rights as a U.S. citizen, they said.

The diversity program, signed into law in 1990 by Republican President George H.W. Bush, was created to provide more permanent resident visas to people from countries with low U.S. immigration rates.

The tweet could be argued as an attempt to influence a jury, but even without the intent, it still puts Trump at risk of being charged with contempt of court. Trump's administration could, at least in theory, still send the suspect to the USA base in Cuba later, though such a step would be unprecedented.

The FBI and New York Police Department are jointly investigating the terrorist attack, the deadliest in New York post 9/11.
