A bench of Justice Madan B. Lokur and Justice Deepak Gupta said Haryana and Uttar Pradesh too, should ensure that retail outlets in the NCR region falling in their states were reduced by 50 per cent.

The court urged the Delhi government and other authorities to consider encouraging fireworks display through community participation rather than individual bursting of fireworks.

While allowing the resumption of sale of firecrackers in Delhi-NCR by lifting the suspension of permanent licenses, the apex court told the Police that up to a maximum of 500 temporary licenses should be issued to shopkeepers this year as the existing stock was enough.

A year ago on November 11, the apex court has ordered suspension of all licences permitting the sale of fireworks, wholesale and retail within NCR till further orders.

The apex court, however, said its order lifting the suspension of permanent licence might require a review after Diwali, depending on the ambient air quality after the festival.

According to reliable sources, changing its order in November 2016 order that suspended all the licenses granting permission for the sale of crackers in wholesale and temporary in Delhi. "However, it is made explicit that the sale of fireworks by the permanent licensees must conform to the directions given above and must be fully in compliance with the Explosives Rules", the bench said.

Regarding the health issues of children and Pollution Court has taken this decision. "The graded and balanced approach is not meant to dilute our primary concern which is and remains the health of everybody and the human right to breathe good quality air or at least not be compelled to breathe poor quality air", the court said.

The bench also noted that there was no response from the states within the NCR, which gave the impression that air pollution was not a problem for them despite the ill-effects and health hazards of bursting fireworks.

The court also directed the Delhi Police to reduce the number of temporary licence by 50 per cent of those granted previous year and cap it at 500.

Similarly, the court said that Delhi police has issued directions that are hard to enforce such as restricting the time during which fireworks can be burst.

The order came on a plea of firecracker manufacturers.

However, it passed various directions for regulating temporary licences. "The health of children should be of foremost concern in this regard", it said.

As a cautionary, the court said: "There must be a concerted effort to ensure awareness and sensitization of the people in Delhi and NCR, particularly children, of the health hazards of indiscriminate use of fireworks".
